It's not an OGL. You are correct, however, that the 5.2 SRD does contain the term 'D&D' on page 5.

You could have different parts of a product use different licenses. Like I said, trickier, but you could do it.

Interesting they have decided aasimar are IP because it was previously OGC from the 3e SRD. That's why Pathfinder was able to use them.
