According to a July 14 press release featured in a video by Ted from Nerd Immersion (linked below), the Black Flag Reference Document is now available with either ORC or CC-BY 4.0 licensing options.

However, neither bfrd.net nor Kobold Press' main page have been updated to reflect this announcement. I trust this link from the PR will go live at some point soon:

It really only makes sense. The ORC license, though born out of good intentions, is just not going to get third parties to use an SRD, IMO. Creative Commons is the way to get movement and momentum.
