They have to either change their content to reflect the changes to the SRD, or they can contact WotC and ask for permission to use the information in their works. Several books that were slated for near future releases have already been cleared for production by WotC (or so I've heard).

Unless there is a "mishap" no charges are released. Mishaps only occur when the skill check fails by more than 10, or the character is trying to activate a scroll and does not manage to emulate a high enough caster level (and then fails the second mishap roll).
