WotC Unveils Draft of New Open Gaming License

It's still unclear to me how they intend to invalidate the previous license. I assume by a trojan horse clause in the new license? But that's not in the draft legalese presented here. And I don't think I'm ever going to accept their new terms anyway. So I guess they'll have to sue me over this...

Legally, yes. But in practice, this sort of thing leads to chilling effects.

Legally? Sure. But ethically, it sure looks like they're stealing from the public commons. Without going into a huge philosophical debate about that, I'm sure you can see how our poor owlbear might meet a similar fate as Cinderella, no matter what its originators might want to claim.

And now I can't sell Cinderella dresses and toys without them breathing down my neck, even if they were original designs based on my imagination from reading the original fairy tales. See what I mean?

Disney straight up steals from fairy tales in the public domain and claim it as their IP. What's your point?

Then they just committed fraudulent misrepresentation to begin with. They’ve made assurances that it couldn’t be revoked in the past. At the very least, this is promissory estoppel.

Even their negotiating tactics here look illegal to me. https://en.wikipedia.org/wiki/Misrepresentation#The_%22untrue_statement%22

So we just initiate protective replication and sublicense between ourselves? I've made a repository here. The owlbear is probably in there somewhere. https://docs.google.com/document/d/1zMLnfW8w8eaP5BpyVs7tjr-Ew2LxOagS5zBu7ayevtg/edit?usp=share_link...

WotC Talks OGL... Again! Draft Coming Jan 20th With Feedback Survey; v1 De-Auth Still On

I think I get where you’re going with that. But I could always license the same stuff, couldn’t I? Instead of accepting WotC’s initial offer, I can accept the contractually mandated offer from some website or pamphlet that has published the SRD in its entirety? At least that’s supposed to be...

WotC Talks OGL... Again! Draft Coming Jan 20th With Feedback Survey; v1 De-Auth Still On

I'm not sure if I follow. Can you explain? If anyone picks up on this offer, they voluntarily surrender the rights of fair use to the Contributor's trademarks and declared Product Identity in consideration, do they not? 7. Use of Product Identity: You agree not to Use any Product Identity...

WotC Talks OGL... Again! Draft Coming Jan 20th With Feedback Survey; v1 De-Auth Still On

Is it really a gratuitous grant though? Anyone granting OGC receives protection from anyone using their declared Product Identity under the OGL without an additional agreement, even when such use would have been permitted under fair use. I am not a lawyer, but this seems like a form of payment...
