    4E still includes both utility spells and rituals which don't inflict damage. Things like teleport and invisibility are still in, though at different levels. I know this makes it harder for you to dislike everything about 4E, but there you are.

    I was thinking along similar lines. Impossible to say how exactly to implement the change until the rules are out, but it might make for a grittier and more believeable game. From a dramatic perspective, I think there's a lot to be said for PCs to sometimes wake up still wounded and feeling awful.

    Seems unlikely that they would have removed flying. For one thing, that would mean no flying monsters or magic-items. Since both are present, flying rules must be included.

    Improved Familiar Question

    Since both feats refer to caster level, rather than class level, I would say that your character will count as being level 5 for determining available improved familiars. On the other hand, the PHB familiar table refers to class level, so you'd only be level 1 for determining familiar abilities.
