    When I first started reading this thread I thought, "No, Empower will work and allow you to exceed the caps of the normal spell--that's the point of the feat." But, having read Hypersmurf's posts, I've changed my mind. I think his interpretation is correct.

    It can't be instantaneous and have a duration. Instantaneous effects exist either for the instant they are cast (i.e. fireball) or from the casting of the spell until something else changes their existence (i.e. wall of stone). Since a Mind Blast has a duration, it is susceptible to dispelling.

    I suppose you could make an argument for that line of reasoning, though I doubt you'd convince anyone that it was the intent of the rules for a monk to be able to select a feat he couldn't use. Why would you bother?

    Not really that abusable. At the cost of at least 1000 xp and a at least 1000 gp you get a cohort of your level that has to pay per point of hp to be repaired. Sounds like a great way to drain party resources to me. If that creature is so powerful that its more of a threat than a party member...

    Do your players use counterspell?

    In roughly 10 years of gaming, I have never seen anyone (PC or NPC) attempt a counterspell. It's just not a mechanic that is intuitive or one that is usually the best option at any given time.
