Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

So this is basically uncharted territory... And no one knows what rocks you could crash into... I was referring to the possibility that IF this went as far as litigation, any wins might be pyrrhic victories with regards to IP rights like the GW case that was referenced in this thread I hope...

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

Has anyone ever tried that before? And by that, I mean creating an open source license, getting people to adopt it, and the forcibly trying to stop them from using it going forward? I feel like this is breaking new ground in some ways... In this case, it feels like things would have to go to...

WotC Talks OGL... Again! Draft Coming Jan 20th With Feedback Survey; v1 De-Auth Still On

Even if what they release by Friday is significantly better, it really is "too little, too late." They kind of nuked the trust bridge from orbit. I doubt they will be able to rebuild it, and that will have short, medium and long term impacts to their bottom line. They took a huge risk with...

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

I mean...if they're going to give you a discount, you might as well keep it for another year. Affinity has some nice software, and even though its not a drop-in replacement for Creative Cloud (and let's be honest, nothing is...), it has one benefit. It's a perpetual license. No yearly...

D&D 5E (2014) So this is how D&D 5e dies, a beautiful start only to die in disgrace because of mismanagement. RIP 5e

Except they've released that IP into the wild with a copyleft license attached. It's hard to pull that back just because they want to change their business model. Their attempt to do so, based on what we've seen so far, are very anti-competitive. Even if they can revoke the current OGL and...

D&D 5E (2014) So this is how D&D 5e dies, a beautiful start only to die in disgrace because of mismanagement. RIP 5e

You might be right there. But I do want to make one thing clear. I don't think that this will be the death of D&D or TTRPGs as a popular hobby. I just think that this might not work out as well as WotC is hoping. Moving any customer from a perpetual to subscription license model is hard in...

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

I think that's a fair point. It would depend on the text of any future ORC license, though. And Paizo, or any publisher, would potentially have the right to republish material under a more restrictive license. I think a big part of the current issue is that WotC owns the current license, the...

95% of you didn't need the OGL and you don't need ORC

I don’t know if I would go that far. While there are still some questions, there was at least one case (DaVinci vs Ziko) that involved copyright infringement of a game with role playing mechanics. And it was found that copying those mechanics was not infringement. But there are still questions...

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

I think it comes down to trust. The 3PPs are using a license that one of the other publishers has created. That publisher also made a set of promises around that license to get others to adopt and trust it. Now the originator (and the only party authorized to release an updated version of the...

D&D 5E (2014) So this is how D&D 5e dies, a beautiful start only to die in disgrace because of mismanagement. RIP 5e

It’s clear that this is where they want to go. A lot of companies are trying to move to a model that generates annual recurring revenue. But I’m not sure this business model change will work out very well for them. While a transition to subscription-based gaming might be a great revenue...

    Hypothetical: I ignore OGL 1.x

That might not be the best example considering his…modern reputation.

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

I realize I'm way out of my comfort zone here. This is not an area where I have a lot of knowledge, but I find this conversation fascinating and have learned a lot about the theories at play here by asking questions. It has really peaked my curiosity... If I cross any lines, either in how I...

D&D 5E (2014) How will the recent OGL developments affect your D&D spending?

While I’m not new to TTRPGs (previously played a lot of Star Wars D6 and some Old World of Darkness), I’m pretty new to D&D. I was planning to start acquiring a lot more WotC and 3PP content as my oldest is now in a TTRPG club at school. I think I’ll just restrict my purchasing to mostly 3PP...

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

But what part of WotC’s copyright was violated? US Copyright Law does not protect ideas, only the expression of them. And there is case law that states that game rules and mechanics cannot be protected by copyright. DaVinci Editrice vs. Ziko, for example (link is to LexisNexus case...

Step-by-step instructions for deleting a D&D Beyond account, from the perspective of a (former) user of the "Free" version

So I started this process earlier this week. It's not an instantaneous request. After a day or two, you will get a reply on your ticket from the WotC compliance team asking you to reply with additional details. You can also request to have your other WotC accounts deleted in the same ticket...

Paizo Announces New Irrevocable Open RPG License To Replace the OGL

Ok. That might have been what you meant, but your original post made it sound like WotC owned the copyright on anything released under the OGL…

I think I get what you’re trying to say.

Paizo Announces New Irrevocable Open RPG License To Replace the OGL

That’s still not very precise. There is a lot of content that is licensed under the OGL that does not originate with, or was derived from, WotC or their SRDs. WotC does not have a copyright on any of that material.
