    My speculation - I think the designers liked the idea of a combat intimidation mechanic, but saw the potential for abuse. The best, or easiest, solution was to leave it up to the DM to make judgment calls, thus "...or a DC set by the DM" was included.

    Nope, only your level or lower. I'm thinking it's 1st level so wizards can take it as one of their 1st level freebies, leaving room for better options for the 5th level one. Maybe AV2 will have some 1st level potions. I really don't know.

    I'm pretty sure a DM gets to make decisions like that! :p The "rule" seems to written intentionally vague, so DMs can interpret on a per situation basis. Intimidate is not an at-will automatic insta-kill on a bloodied enemy.

    I think using the intimidate in combat rule as straight RAW can be bit silly. I would almost never let a PC force a surrender on a bloodied monster if its allies were all still fighting. I allow it is a solution if the threat of an encounter is over, but some monsters fight to death. Period...
