I don't think that's evidence that DMs can't refuse rules, but that is evidence that they like those rules. I used FR rules, monsters etc in my 3.0/.5 home brew game when it wasn't the default setting!

Just on this, I think the strategy is attempting to cover both - I suspect adventure paths are just as much about attracting older players with less time as with making the early experiences of the game accessible for newbies.

There are lots and lots of systems that are classless and don't use spell slots. Why not use one of them?
