That’s not a scam. I understood what they meant and they never pretended they were including Archons or Steel Dragons or whatever you were expecting. They absolutely advertised and previewed that there were a ton of new stat blocks to older monsters.

I don’t remember the books/movies well enough to answer that. And I don’t think it matters to the discussion of Orcs in D&D. Which very much have been presented as innately evil because of their nature in most of D&D’s past.

D&D Orcs are not Tolkien Orcs, and the origin/nature of Orcs is something Tolkien changes his mind on a few times. Also, I don’t know if I’d call Sauron’s realm “fascist.” That’s a pretty specific term that shouldn’t be reduced to just mean “evil.”
