WotC doesn't have legal rights for the mechanic but for the term "tapping". Anyone can make a game that includes a mechanic where cards are turned to indicate they are being used, you just can't call that "tapping".

It's amazing that they can distinguish between what's appropriate for a 17-year old and what's appropriate for an 18-year old.

Even if most players wanted campaigns to last many years, for purely practical reasons it's very hard to maintain a group for that long which means it couldn't possibly have been the norm.
