In my circles, D&D most usually means "roleplaying game with elves, wizards, orcs and dragons". If we need to specify, we refer to the exact version: "Basic", "3.x", "AD&D", "Pathfinder", "Hackmaster" and so on.
The PDF and OGL issues would help, but what would bring me "back" is a good adventure. Right now, Paizo produces the adventures I like to run, and they happen to use Pathfinder RPG, so that's the game I play.
I prefer the PFRPG rules to the 4E ones, but what sells me on one game or another is...
Exactly my thoughts. I even recall (not sure if correctly) one of the preview articles for 4e putting Tomb of Horrors as the example of everything that was wrong from previous D&D editions.

In every other aspect, ruleswise, I consider 3.x/Pathfinder way better than AD&D (1 or 2).
AD&D1 had some great modules, and AD&D2 had some great settings, but both were, IMO, pretty weak rulesystems.
