I've seen rules additions and renovations form many of those products you mentioned turn up over the years. They were not simply closed off-shoots of development. The "feed-back" cycle only had one point where there was a problem: WOTC.

Wayne is right on the mark. Wotc didn't maintain the OGL. They did one major rewrite that not everyone agreeed with. Luckily since wotc has divorced himself from the OGL they have no more voice then all the rest of us in it's future and in practice will have no voice.

Consideration is most certainly there in the GSL. 3pp get to put a D&D logo on a publication and make use of terms in the GSL. Wotc gets support for 4e in the form of material produced by the 3pp that it doesn't have to pay development, advertising, production , storage, warehousing, shipping...

No, it's a contract. It isn't illegal. No one has to use the license, WOTC does not have a monopoly on RPGs. Using that license means you use the whole license.

yup and those cool alphabets in the PHB can't be used by 3pp in adventures since they aren't part of the GSL.

You'd have to make "new" races not simply modify them. Noble Elves, Shadow Halflings, Grim Dwarves, stuff like that.
