    New Character Builder from WotC!

Firstly you're shifting the goalposts here. I assert that a TOS does not replace a signed ownership of copyright. Your point is regarding the violation of terms of service. This thread hasn't been about violating TOS at all. As for your point, it depends on what you mean by 'not a good thing'...

    New Character Builder from WotC!

I changed my post to go through your points one by one as I figured I was doing you a disservice by not answering them, but to take this one as it's very simple. No.

    New Character Builder from WotC!

I can only conclude you didn't actually grasp what I was expressing here. You cannot transfer the copyright of something you have created (and obviously is copyrightable, and you have the right to copyright etc. without a signed document). Ergo I doubt that WotC will claim ownership over such...

What are your indispensible "Hand Waving" tools for coming up with stuff on the fly?

I think this is absolutely dreadful advice for all manner of reasons. Killing their characters arbitarily because they don't follow up on the traintrack you've laid out for them? Shameful behaviour for any GM.

    New Character Builder from WotC!

Why are you continuing to spread this misinformation? I genuinely don't understand why. Either you don't understand how copyright works, in which case you're just spreading uninformed opinion. Or you do, in which case this is some malicious attempt to spread negativity about WotC and their...

The Legality and Difficulties in Harvesting Compendium Data (Hypothetical)

I didn't say you can generalize, but you're wrong on the fair use aspect. We have Fair Dealing as the closest thing to Fair Use which, while better outlined, is far less open and primarily concerning review, study, research, criticism, education, parody and so forth. We do have some fair dealing...

The Legality and Difficulties in Harvesting Compendium Data (Hypothetical)

I could see that argument having some worth while you were still a subscriber, but it'd lose any weight if the subscription ended. And, again, there are many jurisdictions where this wouldn't be a defence at all. Edit: It also goes back to the argument of whether you are paying for the...

The Legality and Difficulties in Harvesting Compendium Data (Hypothetical)

I don't think it's quite as cut and dried. I agree with any normal purchased good/object that it is, but in this case the service is providing access to information stored on a server the subscriber doesn't own. As such it's not as clear that they're format shifting. To be sure it's an argument...

The Legality and Difficulties in Harvesting Compendium Data (Hypothetical)

Edit: In more detail. I'll admit to being overly knee-jerking with my response. Because of my primary work in the past years with european rights infringements and what passes for copyright laws in China, (where fair use doesn't apply in the american form), I forgot this one. Which is also...

November 16th release for Web-based Character Builder

It certainly doesn't eliminate those groups. In both my groups i'm the only one with a subscription, for a variety of reasons (though the mac users might now get one). The change in no way eliminates how I'll be using the CB, or changes my system from how I and the group have used it in the past.

The Legality and Difficulties in Harvesting Compendium Data (Hypothetical)

Irrespective of whether fair use applies (there are good arguments that it doesn't). This (the above) is absolutely not something anyone should rely on as a standard for copyright. It's not something you'll find expressed in court rulings or by the copyright office. Specific 'things' are...

I seem to be missing the point on the online CB

The time it takes to show how an argument uses flawed logic is notably longer than the time it takes to make it in the first place. Your arguments make use of a number of rhetorical fallacies. The primary and most obvious one is the slippery slope but you’ve also gone into Post Hoc...

    Excellent point on WotC mishandling

Writers sometimes get large enough to be considered brands in and of themselves. Sometimes characters or overall design (Harry Potter is a brand for example). Books...they're not considered to be brands. Not in publishing. D&D is a brand. And brands get updated. The new shoe, the new car, the...

    D&D 5E (2014) What’s next for DDI

Firstly I was addressing the suggestion of '1 free month per product bought'. Secondly I was looking at it from the perspective of lost sales from DDI or lost profit from the book (as the money has to appear on someone's accounting line'. Looking at the book, given 'free' stuff is commonly put...

    New Character Builder from WotC!

    1) I highly doubt they'd claim ownership given, in the US for example, there are specific steps in place regarding the transfer of copyright. A transfer of copyright ownership, other than by operation of law, is not valid unless an instrument of conveyance, or a note or memorandum of...

    New Character Builder from WotC!

It's not blind at all. I've been working in publishing and specifically with copyright issues for years. This is what I do for a job. I know exactly what would happen if WotC did exercise their claim in the manner the fearmongering is aimed at suggesting and how bad it would be. Companies...

November 16th release for Web-based Character Builder

Depends entirely on how the DDI team will implement it. We already know you can import. We know they intend to add exporting. It would be logical that exporting just allows you to save the *.dnd4e file to your hard drive and leaves the character in the cloud. It's logical that if you try and...

    Disappointed D&D Insider Customer

Putting this in context: I've worked in publishing for <damn i'm old> There are many freelance writers who post in these forums There are many editors, layout artists and artists who post in these forums There are many publishers who post in these forums Even if only one single sale from...

    Disappointed D&D Insider Customer

Err, yes you can be jailed for copyright offences. Copying and selling of a rights holder's IP has been punished with jail many times. Likewise wholesale distribution of such has seen jail terms handed out in courts. Bob who distributes it because he's getting it via a torrent, he's not going...

    D&D 5E (2014) What’s next for DDI

There are major problems with the coupons/scratch-off system which were expressed back some time after the Rouse mentioned it. Companies A+B that i've worked for in mainstream publishing have both looked at the same idea, and both dropped it for the same reasons. You cannot guarantee that the...
