My DM probably would have killed my character. If I were the DM I would probably have killed the PC as well. Especially since all the appropriate checks were made and the Dwarf basically took no significant measures to defend against the assassin after the first attempt.

If you combine the bad guy's so the CR is maybe two or three higher than the party's CR that should prove to be a tough but fair and challenging fight.

Are you throwing Monsters/ bad guys that are the same CR or lower? If yes, start advancing your bad guys and raise the the CR for them. Add some templates onto your bad guys to add some new flavor. Your adventurers may know how to deal with a CR18 Dragon, but have they dealt with a Dracolich...

Your DM/ friend has it right. Your initiative round 1: you begin casting spell Your initiative round 2: You finish spell, creature appears and acts immediately. You can now act normally.

Here is another idea, I believe in Savage Species, there is a feat that allows you to increase your existing DR by like +2. You might even be able to take the feat multiple times. It might be worth checking out.
