Level up uses exertion points... pretty interesting. I personally like tricks which if an enemy sees the trick it has disadvantage if you try and repeat it, obvious tricks (like a come and get it) can only be used once per set of enemies, period.
Pathfinders separation of feats into different types and costing different design/development resources for the character is what I would have considered an enhancement for 4e.

The skill challenge is rather this in abstract... you could have bursts of speed for athletics and sustaining for endurance and acrobatics for navigating obstacles and streetwise for city based shortcuts and so on... open ended of course.

That is not the distinction in question you cannot copyright a method or idea just a particular expression of it. Express a mechanic (or a story for that matter) differently and it is no longer subject to copyright full stop.
