The rules simply tell you how the magic works. You are not required to cast your spells in the most efficient manner. Casting it at 5th, 7th, and 9th would also be "pointless." Unless you were out of 2nd, 4th, 6th or 8th-level slots for the day and really needed a Spiritual Weapon.
