    Funny. Not only does that strike me as lazy on the dev's part, but it's also not RAW. Toughness can't be taken as a fighter bonus feat. As for the MMIV, I'm not liking what I'm reading. I'll reserve judgment until I see it, but this might be the first MM I don't buy.
