WotC Walks Back Some OGL Changes, But Not All

I don’t have a representative on the Board. That is not how Boards work. All of them, in theory, work for all the shareholders. They don’t assign a board member to shareholders. Investor Relations is also not typically assigned to it. I bought my shares ages ago when I played MtG a lot more...

WotC Walks Back Some OGL Changes, But Not All

Almost all stocks have gone up from that point. I am a Hasbro shareholder and follow them. There does not appear to be any company specific reason for the recent stock moves after the BoA analyst report was absorbed.

WotC Walks Back Some OGL Changes, But Not All

As has been said over and over in this thread: 1. The main places that RPG materials are sold already police material and it will not have access to them 2. Since the OGL clearly says don’t use the trademarks including Dungeons and Dragons, where is the link to D&D? 3. OGL has been around for...

WotC Walks Back Some OGL Changes, But Not All

Your entire list of examples does not use the OGL. So what is your point? How does it relate to this discussion?

WotC Walks Back Some OGL Changes, But Not All

That publisher does not use the OGL and is using trademarks and dress that the OGL specifically forbids. This has been pointed out multiple times in this thread whenever this bad example is brought up.

That was almost as poor as your flights of concern fantasy, but not quite. A bad meme means you have nothing more. How about address the responses or just bow out.

WotC Walks Back Some OGL Changes, But Not All

I think the concern about the brand is a combination of PR to explain why they are doing something terrible (we had to, they made us do it) and possibly some corporate brand person separated from any of the actual examples. That one puerile book from 20 years ago gets trotted out, but it is not...

WotC Walks Back Some OGL Changes, But Not All

There is a near zero chance that any investor will care about some obscure, non-D&D branded, not Hasbro published book that causes a Twitter storm. This is a completely stretched past any reasonable chance. The bigger risk is actually with the proposed branding because it will be splashed with...

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

And you can go ahead and say “Fireball: a bead of fire shoots from your hand and explodes into a 20’ radius ball of fire at a point the caster can see ….” And Wizards can still sue saying too close/derivative work and a trial might be the only way to tell if they are right.

WotC Walks Back Some OGL Changes, But Not All

They want people to not use their trademarks and not challenge their copyright/IP, so they add a big carrot to get people to use the OGL where they promise not to do that.

WotC Walks Back Some OGL Changes, But Not All

The main selling avenues - One Bookshelf and Kickstarter - already police material. There is absolutely zero need for Hasbro/WoTC to have such a clause or to use it as an excuse. They already ban using their brand/trademarks and claiming it is compatible with D&D so they already have plausible...

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

Copyright gets down to exact words being used in most of the cases I have seen. There are only so many plot ideas at a top level. So many novels have the same basic plot and probably the same structure. The details of how it is done becomes the story and using the same words is violating...

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

I don’t think people that don’t have access to Big Law and money to spend understand how much can be done in a legal matter. I use Latham and Jones Day. Have used Kirkland a lot in the past. One phone call and I have a small army of expensive but dedicated and generally really good lawyers. And...

Dismissed with prejudice before discovery. Invest in a good litigator when you need one.

Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

Honestly, when I moved to the USA, I really had to adjust my world view about suing people. It is embarrassing in Canada when it comes to that. Especially in non-business cases. In the USA I think you sue right after you have coffee in the morning. When I was running Legal, the main areas we had...

Raging Swan Press https://www.patreon.com/posts/ogl-1-1-and-swan-77134733 “ The OGL 1.1 and Raging Swan Press I’ve received many questions in the last week about the leaked draft of the OGL 1.1 and its effect on Raging Swan Press. I’ve attempted to set out my thoughts several times. Every...

OGL: What Are The Publishers Saying [UPDATED]

Frog God/Necromancer games from Facebook: “ Frog God Games and Necromancer Games will not sign the new Open Game License (OGL) Version 1.1. Hello, I am lawyer with a PSA: almost everyone is wrong about the OGL and SRD. Clearing up confusion.

As I have said, I am not a lawyer but I did run the Legal department in one of my jobs and spent $10M+ a year. What I learned is that you try and write the best contract in good faith that you can to dissuade people from taking you to court, but in the USA (I grew up in Canada where fighting...
