    Rogues flanking at range?

There is the Distract Assailant (Ass 1, Sor/Wiz 1) in the Complete Adventurer. The target gets a Will save, but if they fail it they are flat-footed until the beginning of the target's next turn. To boot it is a Swift spell (pretty damn sweet for a 1st level spell, perhaps too sweet  ). So...

    Surprised while already in combat?

Absolutely. The opponents get Spot/Listen checks (Listen usually being a lot tougher than Spot in the middle of combat) to see if they notice them. However the special condition of flat-footed definately doesn't come into play.

    Are they dead or not?

:) :) :) I like, but first... I too am very curious why it is that you feel it is up to you to keep track of this. Do you not let the players know about the stat damage?

What is the best way to generate balanced d20 characters?

This gives well rounded, fairly heroic stats with very, very rare "gimped" stats. It yields 18's about as often (with the above method approximately 1 of every 2 characters will have 1 or more 18's), but has smoother consistancy than 4d6. You can regularly expect stats worth 40ish PB. I...

    "Swift" Spells Question

...so then the rest of the standard action is spent admiring the beauty of the spell effects? ;)

    Druid/monk & entangle

Given the power of Entangle as a first level spell (see various other threads here) having areas where it doesn't work seems to be a patently Gud Idder™. EDIT: BTW there is the somewhat cryptic "Note: The effects of the spell may be altered somewhat, based on the nature of the entangling...

    Surprised while already in combat?

Flatfooted? Ya, I think he was thinking about denying Dex and got his wires crossed. "Flatfooted" once you are in combat is tough to create (requires a Faint, etc.). Given that the ghoul should have received a -4 penalty for attacking from prone, it shouldn't be to big a deal to drop dex from...

    Shadow Jumping

Hey, how can you have a caster level when there is no casting? ;P

    Shadow Jumping

Not this idiotic pulling a sentence out of context argument again. ;) You have failed to include the begining phrase of that paragraph: "For creatures with spell-like abilities". Shadow Jump is not a spell-like ability. You can extend this to supernatural abilities if you want, but I'm not sure...

    Shadow Jumping

The problem is that there is no caster level. Since there is no caster level (effectively 0 level) I'd say that there can be no extra "passengers" on that magical ride. Further it the text says that "shadowdancer gains the ability to travel between shadows as if by means of a dimension door...

Caltrops, is this really the intention?

I believe Patryn quoted the appropriate SRD entry from the DR section, they do need to do damage to stop the creature that steps on them. Nasty thought, though that's either a DM choice or a player with lots of cash to burn as you probably won't be trying to pick those caltrops back up again.

    Spellcasting While Raging?

I'm sure you'll find many people that would to object. Just hope that your DM is not one of them. ;) Not sure what Prerequisites you'd put on that Feat. It's fairly powerful both in theory of what it is overcoming, and in the balance of what it means to what a PC can do (your desire is a good...

Caltrops, is this really the intention?

Welll, you could add an extra enchantment to the animated caltrops (magic item that is in CAd IIRC). Those are actually animated constructs, so it is theoritically possible they could be made to trigger a True Strike on themselves.

    Sleeping and silenced rogue, ouch...

Hear, hear! Well I can't say that I'd give "getting drunk" an even standing unless it was a drinking contest or something, afterall some experiences are more equal than others. ;) But ya, I tend to just come up with number based on desired advancement rate and top it off with extra based on a...

    Item to hide identity?

It's just that Nondetection does not explicitly mention thwarting True Seeing. But I guess it does say "divination spells such as" so that is an incomplete list. It's just that True Seeing is sort of different than that list though still a Divination. This might be a holdover from a previous D&D...

    Item to hide identity?

It doesn't directly negate a mundane disguise. However when they see through the magical portion of the disguse that is likely to alert them that something is afoot. The conciquences of that could indirectly lead to uncovering the mundane disguise because of the heightened scrutiny. It's a bit...

    Item to hide identity?

The True Seeing text says it negates ALL illusions. That reads to me even those ones that can cause damage, disability, or death like Color Spray et al. *shrug* Actually worse, they would [likely] judge (<-- EDITED: for better word choice) the polymorph for what it is, someone trying to look...

Assault on Pandemonium - Looking for Epic Spell

He might also want to look into a Mass Charm spell capable of enthralling 10's of thousands of able bodied people that are willing to die in a foreign plane as cannon fodder. :p

    Item to hide identity?

They combined it into one spell with Nystul's Magical Aura, dropped the "Nystul's" of course, and then shortened the name to Magic Aura.

    Item to hide identity?

....and nondetection is it's big brother that guards against other detects, scrys, and such. I assumed he was talking about something with even a bit more oompth that dealt with True Seeing, which Nondetection appears not to. EDIT: Nondetection also only works for 1hr/level, minimum 5 hours...
