I believe the answer is yes. I'll grant it is a little more innocent in a case like that, but really, once one person is 18, they need to wait until the other one is as well.

On players who don't post, I'll usually just write in some reasonable actions for them and move the game along. Metal Joe is my first game to run and I'm still trying to find the right rhythm, but it's getting there. It would take quite a bit of annoyance for me to actually boot someone - but...

I think everyone makes good points so far. Ultimately it is the DM's responsibility to make sure things run smoothly. Players can't be expected to do things on their own (well, unless you tell them to ;) ). That said, I think sometimes a player can help out a lot in jump-starting a game...

Hence the term 'jailbait' - literally, any sort of 'involvement' with a minor can get you thrown in jail. Personally, I think the penalty for this crime is way too lenient. <insert diatribe here> Then again, a lot of our justice system is too lenient.
