i believe the disease is in effect immediately and failing 3 times extends the duration. it'd be a pretty garbage spell if the disease didn't come into effect until after 3 failures.

well, no, they can still make those scrolls, it's just that they can't use them - and the absurdity of such is kind of the entire issue. the bladesinging wizard can use them, though (and make them anyway).

yeah i'd say at most you could turn a crit into a hit by reducing the total to lower then the target's AC. which is still really good, but it's not deleting the hit altogether.
