Well, under the soon-to-be-new d20 system trademark license, they would have to put the "requires the use of..." line in the book. So, it has nothing to directly do with the OGL, but rather the usage of the d20 system logo.

My dice all hate me, except when I'm the GM. The more important the roll, the worse they roll. Without fail. Still, there is enough comedic value that I don't get too depressed about it. However, when I'm running the game, my dice are on fire! Fear me!

I don't have the book, but I'm sure it's pretty safe to say that you are only supposed to use something like Empower once, unless you were to buy Instant Metamagic-Empower again. I would rule that each Empowerment counted as one metamagic.

I'd be VERY surprised if they made a hardcover edition of it. I know that the 1st edition of Fading Suns was done softcover, because I own it. I never looked at the 2nd edition. I wouldn't hold my breath for a hardcover, so find some other reason to buy it. :D
