complete books and ph2 are allowed. so why toughness and not improved toughness?

i want builds, with feats and everything. with the restriction of using 5 levels of assassin in the builds. also i asked for opinions for the two builds i presented.

the character has quite a few disadvantages. he is a level 10 character with !!!!!47 hp!!!!! even the party wizard was more than him. AC 20, so as you can see it's very dangerous to get into melee (and i like melee:p). the dm also gave me a crossbow and not rapid reload. saves are also very low...
