Well, if we go by "standard D&D lore", smoke is a paraelemental (quasielemental?). If you look at the mephits, they all correspond to an admixture of 2 elements. Smoke is air and fire. So it's elemental related, but it's not an "element", since by definition an element is composed of one thing

As a GM I have used old PCs as retired NPCs, or sometimes transplanted them in a completely different campain (From SKT to Drakkenheim). I do try to ask for permission though. If the NPC is merely inspired by a PC, but the name has been changed, the design personality tweaked... I probably...

It also says "with permission". Now, in a sane world, you (a game publisher) would never claimed art was used with permission if it wasn't - it would be a guaranteed way to enrage the artist, far more than just stealing art. But with this bunch, I wouldn't put it bast them...

... that seems like more of a nomenclature tweak than a real difference... or were they really different? (or at least more different than dragons changed over the editions?)
