    They may have gone with a mark replacement system as opposed to an "inviolate mark" for just this reason. Depending on the associated powers available, it may work out that the fighter marks the dragon and does his special follow up that is only allowed on marked enemies, then the paladin...

    It answers the preexisting silly condition of being unable to defend your allies. I'll take that trade.

    Looks like marking is or can be tied to powers. This suggests that it scales. It's also apparent that the fighter, at least, is capable of marking multiple opponents.

    I voted for the tiefling cover. The dragon would have won out, nice dynamic scene going on, except that the dragon looks a little goofy and we can't have that.

    3.5 Identify is a little more charitable, but you're right. It's obnoxious. Moreso if you don't have the right party complement to cast it at all.

    It'd be great if it were simply a skill to detect magic, providing for the literary convention of the rogue or warrior being able to sense the presence of magic by virtue of having been around it for years(high level character with cross class skill).

    I think it's an error. If you get 10 skills it would make more sense if it said to pick from the list first and then 4 additional.
