    I never said Tome of Horrors is canon, but I believe that it does represent the most powerful published version of Orcus to date. And if that version is only Huge, what's up with a Gargantuan one?

    Interesting, but Gargantuan? Even the Tome of Horrors CR 35 version is only Huge. Maybe this set comes with other pieces, like the Throne of Orcus or a couple of minion demons.

    In general, any creature with a 3 or more Intelligence is eligible for taking class levels. The aboleth is another example of a monster listed as advancing by HD but can also take class levels, as shown by the aboleth mage in the SRD.
