That's an easy one to answer, actually. The Flexible Casting ability states that the Sorcerer is "creating" a spell slot, not "regaining" a spell slot. For example, it would be entirely legal for a Sorcerer to wake up fresh from a long rest and convert all their sorcery points to spell slots...
