I know that it was a muddy point in 3.0, but in 3.5, if a creature is unconscious, is he willing (thus forgoing any saves for cures and levitate and things like it) or not (attempting to save vs said harmful effects as well as cures.)?

Is this a legal use of (Epic) weapon abilities: Coup-de-grace, manifester and mind feeder, it's a +12 with the +1 minimum, so you can for 5pps get the dammage you do on a critical hit on a 1:1 ratio back in pps... I find that awfully powerful for a weapon...anyone else?
