D&D 3E/3.5 [3.5 rules] Flesh to Stone & Break Enchantment

So this has probably come up before, but I'm rarely here and can't search, so...

Can Break Enchantment reverse the effect of Flesh to Stone? The FAQ only addresses the fact that it can reverse the effect of a Medusa Flesh to Stone, not the actual spell.

Break Enchantment reads:
This spell frees victims from enchantments, transmutations, and curses. Break enchantment can reverse even an instantaneous effect, such as flesh to stone.

However, it goes on to read:
If the spell is one that cannot be dispelled by dispel magic, break enchantment works only if that spell is 5th level or lower.

Flesh to Stone is a 6th level spell.

Dispel Magic reads:
The effect of a spell with an instantaneous duration can’t be dispelled, because the magical effect is already over before the dispel magic can take effect.

So Break Enchantment specifically says it can reverse Flesh to Stone, but in the same description says it has to be 5th level or lower to work, if Dispel Magic doesn't work, which it doesn't.

Thoughts? Do you allow it to counter Flesh to Stone or not?

Maybe they had an eratta for the Break Enchantment spell? Because d20srd has this text:

"This spell frees victims from enchantments, transmutations, and curses. Break enchantment can reverse even an instantaneous effect. For each such effect, you make a caster level check (1d20 + caster level, maximum +15) against a DC of 11 + caster level of the effect. Success means that the creature is free of the spell, curse, or effect. For a cursed magic item, the DC is 25.

If the spell is one that cannot be dispelled by dispel magic, break enchantment works only if that spell is 5th level or lower.

If the effect comes from some permanent magic item break enchantment does not remove the curse from the item, but it does frees the victim from the item’s effects."

Looks like the flesh to stone example was removed at some point. Which is good, because that was the only thing causing a contradiction.

I believe that what they are referring to there are spells such as wall of force that specifically state they cannot be dispelled by dispel magic -- not all spells with an instantaneous duration (none of which can be dispelled, of course), because break enchantment specifically notes that it works even on instantaneous effects (none of which can be dispelled). If the authors had intended to exclude all instantaneous effects above 5th level, they would have written: "Break enchantment can reverse even an instantaneous effect of 5th level or lower."
