I see what you are getting at. My arguement is based on the flavor text of the feat, which is, admittedly, a bad place to be arguing from.
 

Sorry to hijack...
But can't a THF guy buy one of those "animated" shields?
I know it isn't a feat and it's expensive but it always striked me as odd.

Well, if you use an animated tower shield, you take a penalty to attacks, just like you were using a tower shield.

One of the things in 3.5 that hurts my brain is if a TWF with a buckler gets the -1 to attacks. That'd be odd because a TWF with a small or large shield doesn't get a penalty.

Since the penalty is "due to the extra weight on your arm", I would say a TWF PC doesn’t suffer the -1 for using a buckler.

... because he can't attack at all with that hand, without using the shield itself as a weapon.
