If I am in a class with the advance learning feature (warmage, unseen seer etc.) - do I have to take a spell from the same type? i.e. Could I take a Divine spell as an arcane caster or the other way around?

It should say in the class entry. Warmage reads, in part, "The spell must be a wizard spell, of the evocation school, and of a level no higher than than of the highest-level spell the warmage already knows."

Now, Unseen Seer reads, in part, "The spell must be a divination spell of a level no higher than that of the highest-level arcane spell you already know. The spell can be from any class's spell list (arcane or divine)."

So, the answer is, read the details of the class entry.

Now, PHB II offered an alternative class feature for the Warmage called Eclectic Learning which replaced Advanced learning, allowing you to choose a Sorcerer/Wizard spell from any school, but the spell was treated as one level higher than it is off of the Sor/Wiz list, and you have to be capable of casting it at it's adjusted level. The example they give is Invisibility, normally a 2nd level spell, would be a 3rd level spell for you. With Eclectic Learning you still cannot choose a Divine spell for a Warmage.
