The 'regain one healing surge' part was just a little extra flexibility I put in there. To me, it's the most disposable part of the concept.

How about this:

You must use an Action Point to use a Daily Item power and/or upgrade a Ring power (so two APs to use a ring's upgraded Daily). You can use an unlimited amount of APs per encounter, but can only gain one Extra Action.

Every Encounter gains you one AP. Heroic characters start with 0, Paragon 1, and Epics 2.
