This is being discussed over at opengamingfoundation.org

Clark Peterson brought up this point.

Section 7 of OGL:

"You agree not to indicate compatibility or
co-adaptability with any Trademark or Registered
Trademark in conjunction with a work containing Open
Game Content except as expressly licensed in another,
independent Agreement with the owner of such Trademark
or Registered Trademark."

So it would appear that others have questions about this press release.

that was a funny post if you know who is responsible for the BOEM project

There is a legitmate question as to whether press releases are covered under section 7 of the OGL or merely the products themselves. I am certain that this will be discussed back and forth among the lawyers and wannabe lawyers in the community for some time.

If not, then it should be. In fact all marketing material for the item should be. Otherwise, you could violate it as much as you wished in catalogs, web-sites, in-store displays, anywhere.
