Ok, I work for a 3rd party publisher (RPGOBjects) and I have to say, I disagree with their analogy entirely.
Unless I'm mistaken, this is a very different situation than making something for Vista, it's more akin to making a game for the X-Box 360.
And MS *has* stopped licensing regular X-Box games, which is, to me, the closest analogy to what's happening here.
And no, I don't think the move is sleazy, even though I personally would prefer a product by product split, rather than making companies choose.
I would desire that sort of split A) because I think a company by company split will be a nightmare to oversee and B) out of pure selfishness, because I'd like to support 4e and like the game to get as much support as possible.
