copyright infringement?

Ya know... this thread would be nicer without people being anal about other people's grammar and spelling errors. :] Not all appreciate the corrections.

You are legally allowed to duplicate, alter, and use content in any way you choose in America, as long as you do not distribute it. You can rip CDs till your heart's content, mix them together, sample them, transcribe them to paper, put them on your phone, etc. It's all perfectly legal. It's called fair use.

What you are not allowed to do is bypass copyright protection schemes.

It is NOT fair use. Fair use is only applicable in the following cases (quoted directly from the US Copyright Office)

“quotation of excerpts in a review or criticism for purposes of illustration or comment; quotation of short passages in a scholarly or technical work, for illustration or clarification of the author’s observations; use in a parody of some of the content of the work parodied; summary of an address or article, with brief quotations, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, in a newsreel or broadcast, of a work located in the scene of an event being reported.”

Copying for your own use is, technically, not legal for printed material under any other circumstances. So many people are confused by what the Home Audio Recording Act allows, which is copying for your own use, but it DOES NOT UNDER ANY CIRCUMSTANCES apply to printed material. What you're talking about would fall under the "not worth pursuing a case" area, NOT FAIR USE.

I'm sorry if I sound a little strident in this post, but I've seen WAY too many times people bandy about "fair use" without having the slightest idea of what it actually means in US law.

Actually, he spelled it wrongly. Sorry... ;)

Yalius, thanks for clearing up the issue of fair use. That's why I said Korimyr was incorrect. I just couldn't be bothered spending the energy to explain myself fully. Expending energy to tease Icycool, on the other hand...
