The ruling will apply any time you have the ability to remove an ongoing condition during your turn. For example, the Dreadnaught's "Unfailing Resources" ability, which allows you to spend HP to make an extra save as a free action.</p><p></p><p>In any case, doesn't this apply even if action points aren't in use?
