Do changes in elevation prevent a charge?

From the Battle of All Alignments - an Elysian Thrush is fighting a cat.

The cat is 60 feet away and the Elysian Thrush is on the ground. It needs to fly to get to the cat in one round.

Can the Elysian Thrush elevate, fly forward, and descend towards the cat and still make a legal charge action?

Movement for a charge must be directly to your foe and climbing elevation hinders movement (1 square = 2 sqaures worth of move), another charge no-no. So it looks like the charge would be illegal.

Elevations of less than a 5 foot square are generally not considered in D&D, so yes, go nuts.

He can't get a dive attack though.
