Monte Cook's "Arcana Unearthed" is published under the OGL and uses the 3.0 SRD. And it long post-dates that "gentlemen's agreement" - the licenses had been out a long time by then.
(Note: I'm referring specifically to AU here - "Arcana Evolved" came later, is also OGL, but I think it draws on both 3.0e and 3.5e elements.)
