(DRM, etc) Too much time thinking...

Isn't there some clause in the OGL that says you can use any previously published version of it at your own discretion, thereby making any restriction not in every version (for example the first version) moot?

OGL, yes. System Trademark License, no. The publishers most upset at the time were the smaller publishers who had little brand recognition, and depended HEAVILY on the "d20" trademark to draw eyes to their product.

Green Ronin or Malhavoc didn't object very much. By virtue of reputation, and quality of previous releases, they could release "Flaming Poo: the RPG" as OGL with no trade dress but their own, and many people would at least give it a look-through. Joe Doe, of Doe Gaming, could produce a product with the same name, and possibly get all of three sales.

Holy crap! It's Funksaw!

Yeah, he blessed us with his presence in the DRM thread.

Considering he has a history of loathing d20, I was surprised to see him here. I wonder if he feels dirty for even being here? :)

Good to see new faces here, anyway. Funk, you're welcome here, even if you do loathe all that we stand for. :D

Um, most of the people who had real problems with it were not the big publishers involved in DTRPG, but small fry one-man ops mad that they could not put breastages in their products and use someone elses generously donated advertising to do it.

I was surprised to see a bunch of big publishers ignore some of the explicit terms of the new d20 stl after it came out. I don't know if they got explicit permission for exceptions or just ignored it but there are d20 products with, for example, bare female nipples (Slayer's guide to demons and Book of fiends come to mind). I'm not against such art, I was just surprised to see it after the d20 stl changes expressly forbid such art in a d20 licensed product.

You and me both. The one that stuck out in my mind is re-using the hentai pic from EA: Chaos Magic in the Quint Chaos Mage.

They may actually be right, because the typical, non-internet, non-savvy, uninformed gamer/consumer, typically will just shut the hell up.

The typical non-internet, non-savvy, uninformed gamer/consumer typically doesn't buy pdf gaming products, DRM or otherwise. They cannot "shut the hell up" if they aren't speaking on the subject at all.
