I think you're taking it a bit personally - AFAIK he does that with everyone and with pretty much all posts he reads. You seem to be implying that he's hunting you.

(Only in enervation) Because they are not damage and not the special attack for energy drain. So, the only rules on it are the spell description and the crit section.
