Fighting in Darkness

Say a character with normal vision is fighting an opponent with darkvision. The character in question has a everburning torch to see with, while the creature with darkvision is 60 ft away and firing arrows at the character.

From my understanding, the creature would effectively be invisible, hence getting a +2 to attacks and the character would lose its Dex bonus to AC. My DM, however, also says that my character is effectively blind and so loses a further -2 to AC. That's not right, is it?

Point out to your DM the footnote on the Table of Attack Modifiers:

Invisible +2² +2²

2 The defender loses any Dexterity bonus to AC. This bonus doesn’t apply if the target is blinded.


So if he treats you as blind, the +2 doesn't apply.
