Griffon Cohorts and 3.5

I was looking through the new core books and came across an anomaly. In the DMG the Griffon has an ECL/Cohort level of 10, which I thought was funny given that it was 9 in 3.0 and I never thought it was worth that anyway (more like a 7 or 8). However the 3.5 Monster Manual has cohort ECL adjustments for a number of monsters that are possible cohorts and the Griffon is listed as a +3 with a base CR of 4. Presumably giving a ECL of 7 when used as a cohort, which is about what I always thought it should be.

Am I missing something in cohort ECL adjustments that explains the discrepancy. If not which one would you consider correct?

Griffons would still be counted as 10th lv for the purpose of Cohorthood. You apply the ECL modifier to their 7 HD rather than their CR.

Though technically if you took a griffon cohort he would come equiped with 10th lv NPC gp value in gear. You might be able to bargin with your DM to have griffon with no gear count as a Cohort 8 or 9.
