I think he should get it for the logical (to me anyway) reasons I noted above. If you think he shouldn't for game balance reasons, thats cool too. But does anyone have any reasons why there is anything fundamentally different between fooling an item and fooling an area of effect from a spell? You might argue that whatever the rogue is doing to "emulate" has some visual component to it, and thus may not be entirely effective when trying to fool someone that is casting know alignment on you.
