Just to cover both threads, from Baneful Polymorph:

Done as an attack, save bonus.
Done because you weren't trakcing your HP in a larger form - see barbarian rage reprocussions

EDIT: As Baneful Poly states 'would prove fatal', it seems to indicate that a con change would affect HP.

Trust me. I have this whole thing down cold.

I usually keep 9~10 character sheets, all updated with the stats for the various animals I would want to WS into at any time. Poisons fly all over the place, and we have a Barbarian, so I'm well accustomed on how to handle this stuff.

I'm just saying as a name convention, this would help clarify this.

WHOA... Wait a second here:

If this second save fails, the creature loses its extraordinary, supernatural, and spell-like abilities, loses its ability to cast spells (if it had the ability), and gains the alignment, special abilities, and Intelligence, Wisdom, and Charisma scores of its new form in place of its own

Baneful Polymorph affects mental, not physical. You turn the guy into a rat, with a rat mind, but it keeps strength/dex/con?

That's gotta be a typo.

Course, going by the letter of the rules... there's no fish listed in the MM to change your opponent to.

True, but that is a level of rule lawering even I won't go to. Obviously there are fish somewhere.

No typo, just incomplete. The SRD 3.5 states that baleful poly works as polymorph except as listed. Fail both saves and you really are a toad.

You're only looking at the second save, which you only save against if you fail the first. The first save is what gives the physical stats.
