Interplay shut down

Just a quick update from www.avault.com:

Interplay Entertainment reopened for business Tuesday after being shut down last week for not complying with California state labor laws. Chief executive Herve Caen said the Irvine-based computer game developer has reinstated its workers compensation insurance - the key reason the state barred Interplay's 79 employees from working. But Interplay still has a rough road ahead. The Orange County Register says the company is nearly out of cash and hasn't paid employees for weeks. It also owes nearly 180 thousand dollars in payroll taxes and penalties. The company must also vacate its headquarters on Von Karman Avenue by June 15 according to an agreement with its landlord (which sued Interplay for not paying rent since January). And Interplay's majority owner - Titus Interactive in France - filed for bankruptcy on Monday. Caen said Interplay is counting on finding new funding through investment bank SG Capital.

I totally disagree. Until you can prove that those employees actually volunteered to work without pay, I have to side with them. Like many of us, we go to work expecting to get paid and receive additional benefits to maintain a standard of living.

If our employers chose not reward us after the service we have done for them, then they breach the agreement between employer and employee.

From a practical standpoint none of that matters.

If they can't afford to pay your salary, they're not going to be able to afford to pay any settlement you may receive in a civil court. In the end you're not going to get even a fraction of your back pay, let alone your benefits.

By staying and sticking it out in the faint hope that someday they'll get it together, you are only going to screw yourself in the end.

Winning a lawsuit is great in theory...but when you come out of it in the hole because the loser doesn't have any means of paying the settlement, and you still owe your lawyer untold legal fees...theory quickly dims to the harsh cold of reality.

These sods are probably holding out a glimmer of hope that they will get some back pay. They have little hope of just jumping ship and getting an instant check elsewhere. If they leave the company and just stop working, their chances of seeing anything decreases exponentially.

What do I expec them to do? I expect them to be proactive & take responsibility for their own lives.

Sorry but I've been in their shoes. When I was younger I worked for a company in financial trouble that was having problems meeting payroll. After the second missed check I went out, found a menial job (that paid substantially less) & immediately tendered my resignation.

Two weeks later I received a paycheck from my new employer. My former co-workers received nothing.

Two months later I was hired by a competitor of my former employer making a little bit more than my previous salary. My former co-workers received nothing.

Two years later I was still working full time. My former co-workers filed a class action suit against our former employer...they never received another dime.

If you continue to work for a company that is not paying you....you hve no one to blame but yourself.

Do whatever it takes to find work & support your family, swallow your pride, go out & flip hamburgers for $8 an hour if you have to. Don't waste your time waiting for a paycheck that will never come.

Krieg is right. People think if they "stick it out" they will be rewarded --- either by their employer or in court. WRONG! The company will never pay you a dime, no matter how much you sue. It simply goes bankrupt and you go to the unemployment office looking like a moron (even moreso if you hired a lawyer and are stuck paying his legal fees for a judgment you'll never collect).
