He's not talking about the caster level of items in the DMG. He's asking if a sorcerer can make an item that uses a 3rd level spell with a caster level of 5.

Although you're now talking about potions and wands, the example in the original post was about a "ring of flying". Under the DMG rules, you cannot alter or scale down the caster level of a non-potion/scroll/wand.

Which was my point For potions, scrolls, and wands, whee you're duplicating the spell, the caster level cannot drop below the minimum caster level of the spell.

He wasn't asking about a DMG item, he was asking about a custom item, so it's DM's discretion. He was treating the guidelines as gospel, hence his question.
