Generally yes (unless at some point in future it's found that it isn't). I think they had a lending program that was shut down.
I think a slightly more nuanced answer might be: "The Internet Archive's practice of hosting content has not been found to be illegal in general, but the copy (or copies) of Jakandor: Isle of Destiny that can be found on the site are almost certainly infringing copyright and were probably uploaded in violation of the site terms of use. Wizards of the Coast is likely aware that the Internet Archive contains material for which they own the copyright but has evidently not requested that that content be removed, since if they were to do so, the site would indeed remove that content. Given all of this and ENWorld's own Terms and rules (which include linking to inappropriate content), it would probably be prudent to avoid posting direct links to WotC content hosted by the Archive."​
