Can anybody explain to me why this is a Necromancy spell?

Because Mark of Justice is based on Bestow Curse which is a Necromancy Spell.

Well, my response is the same as already been said -- because it is based on Bestow Curse.

One possible stretch interpretation could further ellaborate and say 'cause you are bidding that your soul will not do X,Y, or Z... the inclusion of the soul into the equation is what makes it necromancy

(yeah, as I said, that spin on it is stretching it a bit)
