Mid-Air Legion of Sentinels: does it really work?

It's fun to use this spell on a creature with a minimum forward speed (maneuverability average, poor, or clumsy). They still provoke AoOs if they fall, right?
Falling creatures provoking AoO's? Sure they do. (Though, if they're falling from great height at great speed, I could imagine a DM making some ad-hoc ruling with a mischance).

Of course, we haven't really resolved how legion of sentinels should really work - I think the straightforward interpretation is almost unplayable, and it's also weird enough that I really don't think it was the intent - but who knows? I'm going to put it on the "not recommended" list for my players anyhow. I'd rather they invent their own spell with a similar tone but easier mechanics than actually use Legion of Sentinels as is.

Region of sentinels creates ghostly warriors in a 10ft. emanation from a point in space.

Would this spell work in mid-air, creating approx. 32 swordsmen - by a reasonable interpretation? Do you think it's intended?

Are there mitigating factors?

It should work. However, your next problem is forcing an opponent through the field.

Something about your take on it bugs me - I recall some players using it to great effect when they had a beguiler.
